To have your Virginia DUI charges expunged, you will need to file a petition for expungement in the necessary circuit court. This petition will require a copy of the warrant(s) or indictment(s) of the charge(s) which you want to have expunged. You will also need to submit your fingerprints (with the petition for expungement) to the Central Criminal Records Exchange (CCRE).

Once the petition for expungement is submitted, the court will conduct a hearing on whether to have your charges expunged. If the expungement is granted, then your Virginia DUI charges will be sealed from your permanent criminal record. This means that no one will see this on your criminal record other than authorities and governmental bodies. Therefore, you will not have to disclose your DUI charges to employers, landlords, or universities.

However, you can only expunge a DUI charge if it was dismissed or acquitted at trial. Once you are convicted, your record cannot be expunged.
