Invalid Stop as a Legal Defense in a Virginia DUI Case (Part B)

Changing Lanes without a Signal

Many people believe that in Virginia, changing lanes without properly signaling is a traffic violation. However, Virginia statutes state otherwise. A driver is only required to use their turn signals if there are other vehicles nearby. And because most DUIs happen at night, there are often not many cars in the vicinity of other vehicles. A Virginia DUI defense attorney may use this argument in your DUI defense.

An Anonymous Tip from a Citizen

Since the advent of mobile phones, concerned drivers have reported more and more on the suspicion of intoxicated drivers. But Virginia law requires that an officer must obtain "sufficient corroborating evidence" from a caller that proves:

  • Who the caller is
  • How they obtained their knowledge
  • What this knowledge is that lead them to believe that someone is driving while intoxicated

If the officer has not obtained this information, then the traffic stop was not valid and the Virginia DUI charge must be dropped.

Fighting Your Virginia DUI Charge

These are only a few examples of potential ways to question a Virginia DUI charge in court. An aggressive defense can raise dozens of issues which can be used to win your case or reduce your DUI charges. The first step to beating your Virginia DUI charge is to contact an experienced Virginia DUI defense attorney.

A good Virginia DUI defense attorney should have years of related experience. They should have represented similar cases in court, and have a record of success. When interviewing potential DUI attorneys, always ask how many years of experience they have representing Virginia DUI cases.

You should also find out:

  • How many cases they have taken to trial;
  • What the potential legal costs are; and
  • What challenges they see in your case.

Due diligence will help you choose the right Virginia DUI attorney for your case.
