On October 26, 2006, Bob Battle was the legal expert guest on the Chip Franklin show on WBAL radio in Baltimore, Maryland. Bob discussed the constitutionality of DUI roadblocks. He also discussed the United States Supreme Court's ruling stating that such roadblocks were an exception to the Fourth Amendment of the Constitution. Bob Battle also discussed the series of state and federal rulings that have led commentators to state that there is a DUI exception to the Constitution. Bob Battle pointed out that there is a danger that the concept of allowing such special needs searches will be invoked when the government needs to find legal footing for its actions in the war on terror. In fact, the White House has already cited the United States Supreme Court's decision allowing DUI roadblocks to support its argument for warrantless wiretapping.
