According to Virginia State Police, on the night of June 14, a 5-year-old Eastern Shore boy died after being ejected from a car his aunt was driving. She was later charged with drunken driving (DUI). According to Virginia State Police Sgt. Michelle Cotten, the one-vehicle crash took place at approximately 9:30 p.m.

Cotten said that on the night of the accident, 27-year-old Birdsnest resident Nikia Upshur was driving on U.S. 13 just south of Sylvan Scene Drive, when the Chrysler Sebring she was driving entered the median.

According to Cotten, the car overturned and Kioakus Lamont Upshur, Jr. was ejected from the vehicle. Cotten said he was pronounced dead at the scene and the mother was later notified.

According to Cotten, Upshur was charged with driving on a suspended license, DUI, and failure to have a child in restraints in a vehicle.
